Terms & Conditions for the Sir Bob Charles Golf Centre Membership Promotion Giveaway:

• Promotion:
  The Sir Bob Charles Membership Drive (Promotion) is promoted by Sir Bob Charles Golf Centre (Promoter).  Participating in this Promotion is deemed acceptance of these terms and conditions (Terms) and acceptance of any other applicable policies or requirements relating to the Sir Bob Charles Golf Centre.  
• Promotion Period:
  The Promotion starts at 12.00am on 1 October 2026 and ends at 11:59pm on 31 December 2026.
• Eligibility:
  ( A )    ThePromotion includes all new and renewed Sir Bob Charles Golf Centre memberships successfully purchased during the Promotion Period.
  ( B )    A membership purchased before or after the Promotion Period will not be eligible for the giveaway.  
  
• How to Enter:
  ( A )    To enter, purchase or renew a Sir Bob Charles Golf Centre membership during the Promotion Period.
  ( B )    Automatic entry is granted upon the successful completion of membership registration and payment.
  ( C )    There is a limit of one entry per membership purchase.
  
• Prize:
  ( A )    The prize is the Ultimate Game Upgrade, comprising: 3 x 1-hour private coaching sessions with Rodney Yee, NZPGA Coach of the Year 2024, and a custom club fitting experience with Matt Holten, Sir Bob Charles Golf Centre's Club Fitting Specialist.
  ( B )    The prize is not transferable or redeemable for cash.
  ( C )    Prize components are subject to availability, and booking dates and times will be arranged directly with the winner.
  ( D )    If any specified prize component becomes unavailable for any reason, Sir Bob Charles Golf Centre reserves the right to substitute that component with a similar prize of equal or greater value.
  
• Payment and Fees:
  ( A )    All prices displayed in relation to the Promotion are in New Zealand Dollars (NZD) and include  any goods and services tax chargeable under the Goods and Services Tax Act 1985 (if applicable).  To qualify for entry, an eligible membership must be successfully purchased and paid for during the Promotion Period.
  
• Draw and Winner Notification:
  ( A )     The winner will be randomly drawn on 10 January 2027 at Sir Bob Charles Golf Centre.
  ( B )    The winner will be notified via email or phone within 5 business days of the draw. If the winner cannot be contacted within 10 business days, a new winner will be drawn.
  
• Refunds & Exchanges:
  All sales are final, and memberships are non-refundable and non-exchangeable as per Sir Bob Charles Golf Centre refund policy and terms and conditions.
  
• Privacy:
  Personal information collected as part of this Promotion will be used in accordance with the Privacy Act 2020. Information will only be used for the purposes of conducting this Promotion and for subsequent marketing where consent has been provided or otherwise permitted by law, in line with Sir Bob Charles Golf Centre's privacy policy. Entrants' details will not be shared with third parties without consent, except where required or permitted by law.
  
• General:
  ( A )    Sir Bob Charles Golf Centre reserves the right to amend or cancel the promotion and these terms and conditions at any time, with reasonable notice.
  ( B )    By entering, participants agree to be bound by these Terms and any decisions made by Sir Bob Charles Golf Centre in relation to the Promotion.
  ( C )    The Promoter and its related affiliates, employees and agencies shall not be liable for any loss or damage whatsoever which is suffered by any person in connection with this Promotion, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of using the membership and/or prize, except for any liability which cannot be excluded by law.
  ( D )    Participants have rights under the New Zealand Consumer Guarantees Act 1993, which cannot be excluded or limited by the Promoter. These rights include statutory guarantees that any goods provided by the Promoter will be of acceptable quality and fit for purpose and that any services provided by the Promoter will be rendered with due care and skill. These Terms do not intend to exclude or limit those statutory rights in any way. However, to the extent it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the membership as part of this Promotion and will not be responsible for breach of such representations or warranties.  
  ( E )    The Promoter reserves the right to verify the validity of any entry and may, in its reasonable discretion, refuse or invalidate an entry where a participant has not complied with these Terms.
  ( F )    The Promoter and any other agencies associated with this Promotion will not be responsible for any incomplete purchase of a membership, including but not limited to purchases not completed due to technical problems. Purchases are deemed to be made at the time of receipt by the Promoter's database (as applicable), and not at the time of transmission by the participant. Records of the Promoter are final and conclusive as to the time of receipt.
  ( G )    Any cancellation, termination, modification or suspension of the Promotion will be notified on the Promoter’s website https://www.sbcgolfcentre.co.nz/
  ( H )    If all or any part of any term or condition contained in these Terms shall be declared or become unenforceable, invalid or illegal for any reason, such term or provision (or part thereof) shall be deemed severed from these Terms to the extent of the unenforceability, invalidity or illegality and the other Terms hereof shall remain in full force and effect as if the offending term or provision (or part thereof) had not been inserted herein.
  ( I )    This Promotion is governed by the laws of New Zealand. The courts of New Zealand shall have exclusive jurisdiction to hear and determine any disputes that may arise in relation to this Promotion. Participants agree to submit to the jurisdiction of the courts in New Zealand.
